General Terms and Conditions for the Startsafe Option

Your refund service from Datasport.

1. Subject of the Contract

The "Startsafe Option" (hereinafter the "Option") is an additional service offered by the respective event organiser in connection with participation in the sports event. In return for payment of a one-time protection fee, the organiser grants the participant a refund of the entry fee paid upon the occurrence of defined events. Datasport AG (hereinafter "Datasport") is mandated by the organiser to handle the administration of this Option (collection, assessment, payout) and acts as the organiser's authorised representative.

This is a protection option within the framework of the legal relationship that arises between the athlete and the organiser upon registration for the event.

2. Conclusion and Validity

Time of purchase: The Option can be purchased exclusively and directly during the online registration process, in the shopping cart. A subsequent purchase after completion of the transaction is excluded for technical and legal reasons. The contract for the Option is concluded with the respective organiser; Datasport acts as the organiser's authorised representative.

Account requirement: Conclusion of the contract mandatorily requires a registered and active myDatasport account.

Period of validity: Protection begins upon successful payment of the registration and ends with the official start of the respective event or with the transfer/resale of the starting place.

3. Contracting Party and Eligible Persons

Contracting party: The organiser's contracting party is the natural or legal person who completes the registration process for the sports event and pays the protection fee.

Eligible persons: The contracting party is responsible for ensuring that the data of all persons registered through their account (e.g. team members) is correct. The right to a refund exists for all persons of the respective booking for whom the protection fee has been paid.

4. Covered Events (Grounds for Refund)

A right to a refund exists if participation becomes impossible as a result of one of the following events occurring after the purchase:

  • Illness/injury of the participant: Illness or injury of the participating person on the day of the event (substantiated by a medical certificate).
  • Serious illness of a close person: Serious illness or serious injury on the day of the event of a person close to the participant (substantiated by a medical certificate).
  • Pregnancy: Pregnancy of the participating person where the date of the event falls beyond the 24th week of pregnancy (substantiated by a medical certificate).
  • Birth & complications: Expected date of birth or pregnancy complications of the participant or of a very close person from three weeks before the event (substantiated by a medical certificate).
  • Damage to property: Serious damage to property at the place of residence (e.g. due to fire, natural hazards or theft) that makes the physical presence of the person absolutely necessary (substantiated by an official document from the authorities or an insurer).
  • Travel disruption: Technical failure of public transport or accident/breakdown of the privately used vehicle during the direct journey to the start location (substantiated by an official document from the authorities or an insurer).

5. Exclusions

A refund is expressly excluded in the following cases:

  • Event cancellation: Cancellation, postponement or abandonment of the event by the organiser, the authorities or due to force majeure.
  • Weather: Bad weather or unfavourable weather forecasts.
  • Pre-existing conditions: Conditions that already existed at the time the service was taken out or that were foreseeable as a consequence of planned medical procedures.
  • Personal reasons: Lack of training, lack of motivation or other private reasons for being unable to attend.
  • Telephone consultations: Certificates based solely on a telephone consultation without a physical examination by a doctor.
  • Pandemics: Events related to pandemics.
  • Misuse: Intentionally false statements or concealed facts.

6. Refund Process and Benefits

6.1 Assessment and decision

The assessment of the submitted evidence and the decision on whether to approve a refund is made by Datasport. Datasport decides on this conclusively, taking into account the documents submitted. There is no automatic legal entitlement to a refund if the evidence requirements are not met.

6.2 Payout/credit

In the event of a positive decision, the refund is made primarily in the form of a Datasport voucher in the amount of the entry fee paid. The voucher is tied to the contracting party's myDatasport account and can be used for future registrations.

If the contracting party prefers a cash payout instead of the voucher, this can be requested by e-mail after receiving the voucher.

In the case of a cash payout, a small service charge to cover the administrative and transactional effort is deducted from the refund amount.

The payout is made to the means of payment used during registration or by bank transfer through Datasport as the body mandated by the organiser.

6.3 Non-refundable costs

The service fee for the Startsafe service as well as the handling fees incurred during registration and any other booked options (e.g. merchandising, SMS services) are not refunded under any circumstances.

7. Obligations in the Event of a Claim

The claim must be reported to Datasport via the online tool within 30 days of the occurrence of the event. The following documents must be submitted:

  • A detailed medical certificate (incl. diagnosis) issued no later than 30 days after the event. The certificate must be based on a personal, physical examination.
  • In the case of infections, the corresponding laboratory report (PCR test).
  • In the case of deaths, property damage, travel disruption or other events, the corresponding official documents.
  • The original booking confirmation.

8. Right of Withdrawal for Consumers

Consumers have the right to withdraw from the Option within 14 days of conclusion without giving any reason.

Special note: The right of withdrawal expires prematurely if the service has been fully rendered with the express consent of the consumer or if the event has already taken place.

9. Final Provisions

The law applicable at the registered seat of the respective organiser, or as set out in the organiser's terms of participation, shall apply. The provisions of this contract apply to the administration carried out by Datasport.
